1. Acceptance of Terms
By accessing or using mayaness.org (the "Site"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the Site. These Terms apply to all visitors, users, and members of the mayaNess Society ("mayaNess", "we", "us", or "our").
2. Eligibility
Use of the Site is intended for individuals aged 18 and over. By using the Site, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms. Membership in the mayaNess Society is subject to the Society's membership terms and eligibility criteria.
3. Intellectual Property
All content on the Site — including text, graphics, logos, frameworks, white papers, assessment materials, and software — is the exclusive property of mayaNess Society or its licensors and is protected by applicable intellectual property laws. mayaNomics™, mayaNess™, and Karma Capsule Network are proprietary frameworks. You may not reproduce, distribute, modify, or create derivative works from any Site content without our prior written consent.
4. Permitted Use
You may access and use the Site for your personal, non-commercial informational purposes only. You agree not to: use the Site for any unlawful purpose; attempt to gain unauthorised access to any part of the Site or its systems; scrape, crawl, or harvest content without permission; transmit any harmful, offensive, or disruptive content; or impersonate any person or entity.
5. Membership
Membership in the mayaNess Society is by qualification only. Submission of a membership application does not guarantee acceptance. mayaNess reserves the right to accept or decline any application at its sole discretion. Accepted members are bound by the Membership Terms & Conditions, which form a separate agreement incorporated by reference into these Terms.
6. Payments and Subscriptions
Fees are stated in USD. The Refund Policy governs refunds for memberships, eligible electronic downloadable products, certification-test access before a test is taken, vouchers, keys and online self-learning materials. Eligible electronic products receive a full refund when requested within 60 calendar days of purchase. Online tests are non-refundable once taken. Live, recorded and podcast learning is fully refundable within 60 days of first attendance when less than 50% has been attended or accessed; no refund applies after that threshold. In-person seminars, summits and conferences are 50% refundable when cancelled more than 72 hours before the event and non-refundable within 72 hours. Software and Commons Projects access is non-refundable after 60 days from first licence use or first system access.
7. Assessments, Events and Certificate Lifecycle
Where a programme, assessment, evaluation, quiz, or certificate-bearing event includes a credential outcome, access is delivered digitally after confirmed payment. A candidate must complete the stated requirements and meet the published passing standard. A passing result creates a certificate record with a unique verification ID. The record is subject to internal re-verification and Chair signature before the signed certificate is released in the member portal and by email. Certificates may be verified through the Society’s certificate verification service. Unless a programme states otherwise, assessment eligibility and included retakes expire one year after the first attempt. After included attempts are used or eligibility expires, a certificate-only retake purchase may be required. The Society may withhold, correct, revoke, or reissue a credential where there is an administrative error, integrity concern, or material breach of these Terms.
8. Disclaimers
The Site and its content are provided "as is" and "as available" without warranties of any kind, express or implied. mayaNess does not warrant that the Site will be uninterrupted, error-free, or free of viruses. Nothing on the Site constitutes financial, investment, legal, or professional advice. You rely on any information provided at your own risk.
8. Limitation of Liability
To the fullest extent permitted by law, mayaNess Society and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Site or its content, even if advised of the possibility of such damages. Our total liability to you for any claim shall not exceed the amount you paid to us in the twelve months preceding the claim.
9. Third-Party Links
The Site may contain links to third-party websites, including mayakannan.com, karmacapsulenetwork.com, and external payment processors. These links are provided for convenience only. mayaNess has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party sites. We encourage you to review the terms and privacy policies of any third-party sites you visit.
10. Governing Law
These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts. If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
11. Changes to These Terms
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Site with a revised "Last Updated" date. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
